2. Scope

These terms and conditions of sale govern all orders placed on thepaintingstudio.art. Placing an order implies full acceptance of them. They may be amended at any time; the version applicable to an order is the one online on the date that order is placed.

3. Products

We sell hand-painted oil reproductions of works in the public domain, and original works commissioned from a photograph supplied by the customer.

Each reproduction is painted by hand. It is therefore a unique object: minor variations in brushwork, texture and colour compared with the images shown on the site are inherent to the technique and are not defects. The original signature of the reproduced artist is never imitated; the painting is signed by our artist under their own name.

Product photographs on this site show the original works, held in public collections, for reference. They are not photographs of the individual canvas you will receive.

4. Prices

Prices are shown in euros, inclusive of all taxes. Any applicable delivery charges are indicated before the order is confirmed. We reserve the right to change our prices at any time; the price charged is the one displayed at the time of the order.

Orders shipped outside the European Union may be subject to customs duties, import taxes and clearance fees payable in the destination country. These are the customer’s responsibility.

5. Ordering and payment

Order confirmation is sent by email. Payment is taken in full at the time of order, by the means offered at checkout, and is processed by WooCommerce Payments (Stripe). Card details never transit through or get stored on our servers.

We reserve the right to refuse or cancel any order in the event of an existing dispute with the customer, a manifest pricing error, or reasonable suspicion of fraud.

6. Production and delivery times

Every canvas is painted to order. Production takes 10 to 20 business days depending on the complexity and the size of the work, to which delivery time is added. Delivery times are given as estimates and are not binding. Delay does not entitle the customer to cancellation or compensation, without prejudice to their statutory rights.

Shipments are insured against loss and damage. Please inspect the parcel on delivery and report any visible damage to the carrier and to us within 3 days.

7. Right of withdrawal

Under Article L.221-18 of the French Consumer Code, consumers based in the European Union have 14 days from receipt of the goods to exercise their right of withdrawal, without giving a reason. The Painting Studio extends this period to 30 days as a commercial gesture.

To exercise it, contact us at hello@thepaintingstudio.art. Goods must be returned in their original condition and packaging. Return shipping costs are borne by the customer unless the item is damaged or does not conform. Refunds are issued within 14 days of receipt of the returned item, using the original payment method.

Exception: under Article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. Custom commissions painted from a customer-supplied photograph therefore fall outside the right of withdrawal once production has begun. This does not affect the legal warranties below.

8. Legal warranties

All our products carry the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code). Under the warranty of conformity the customer has two years from delivery to act, and may choose between repair and replacement, subject to the cost conditions set out in Article L.217-12.

9. Intellectual property

The works we reproduce are in the public domain. The rights to the reproduction produced by our artist, and all content on this site (texts, layout, trademarks), belong to The Painting Studio or its partners and may not be reproduced without prior written permission.

For custom commissions, the customer warrants that they hold the rights to the image supplied and indemnifies The Painting Studio against any third-party claim in that respect.

10. Personal data

Personal data collected is processed in accordance with our Privacy Policy.

11. Governing law and disputes

These terms are governed by French law. In the event of a dispute, the customer is invited to contact us first in order to seek an amicable settlement. Failing agreement, consumers may use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr, or refer the matter to a consumer ombudsman. Failing that, the competent courts are those provided for by law.
